ISF (10+2)
Legislation passed by the US Congress in October of 2006 empowered US Customs and Border Protection (CBP) to collect additional data elements prior to ocean vessels being loaded for export to the United States. CBP has published its Interim Final Rule on Importer Security Filing (ISF), a.k.a 10+2. Effective for all cargo loaded for shipment to the United States on or after January 26, 2009, 10+2 is an advance notice requirement far more rigorous than anything before it and is reshaping supply chain management practices for companies around the world.
What is 10+2?
- The requirement to file 10 data elements with CBP 24 hours prior to loading an ocean vessel. This responsibility rests with the Importer.
- The requirement to file 2 data elements with CBP no later than 48 hours after departure. This responsibility rests with the Carrier.

Importer Responsibilities and Challenges
The ISF Importer is required to ensure that the ‘10’ data elements are filed according to the 24 hour schedule. Accuracy and timeliness of information remains the responsibility of the Importer. An ISF Importer may be the owner of the merchandise, purchaser, consignee, or agent thereof.
- Collection of the ISF data.
- Selection of a secure and reliable electronic means of preparing and filing the required data.
- Ensuring the confidentiality of the commercial information is maintained.
Informed Compliance
CBP has stated that a 12 month period of ‘flexible enforcement’ will allow Importers to meet the various challenges imposed by these new regulations. However, when this period expires, CBP will begin standard enforcement policies, which can lead to penalties and compliance exposure for Importers. CBP has indicated that they will take into account good-faith efforts of Importers to comply with the regulations within the preceding 12 months, and as such, we are encouraging all parties affected by this legislation to take proactive measures to comply as soon as possible.
