Important Reminder to Bonded Warehouse Operators: Compliance and Customs Penalties
To release goods from your bonded warehouse:
Goods may not, under any circumstances, be removed or shipped from your bonded warehouse area until they are released for Canadian consumption (type 20) or export (type 21) by Canada Customs.
Record keeping:
You are required to maintain complete records for a period of six years for all bonded warehouse imports (type 10) and ex-warehouse entries (type 20 and 21). This requirement applies to bonded warehouses operated by the importer or by an independent third party.
US valuation:
If you are Customs releasing goods from your bonded warehouse for export to the USA (type 21), please ensure you are declaring the correct value for US customs purposes. Some companies have established transfer pricing methods and others are utilizing the first F.O.B cost. Both of these methods imply that the selling price to the ultimate buyer in USA not be utilized for US Customs valuation purposes. This is a complicated matter and we suggest that you contact our consultants to review your particular situation and valuation method.
Administrative Monetary Penalties (AMPS) for non-compliance:
Bonded warehouse operators must make certain that they:
1. Provide any Canada Customs officer with access to their bonded warehouse when requested (refer to AMPS Contravention C046);
2. Do not alter or manipulate goods in a manner not prescribed by Bonded Warehouse Regulations (refer to AMPS Contravention C210);
3. Do not remove unreleased goods from a bonded warehouse (refer to AMPS Contravention C066);
4. Ensure the safety and security of goods in their warehouse (refer to AMPS Contravention C196);
5. Restrict access to persons in their warehouse (refer to AMPS Contravention C198);
