ANTI-DUMPING DUTY CONTINUES ON SUGAR FROM THE U.S.

 

On February 17, 2010, the Canadian International Trade Tribunal (CITT) initiated a review to determine if the expiry of Special Import Measures for the dumping of refined sugar originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and


DUTY DRAWBACK OPPORTUNITIES SHOULD NOT BE MISSED

 

Companies that pay duty on imported goods are eligible for a refund (drawback) of that duty if the goods were:

  • exported in the same condition

  • exported after having been further manufactured or processed

Drawback on “same-condition” goods is applicable even if the goods are exported to the United States and Mexico.

 


AUDITOR GENERAL’S REPORT AFFECTS IMPORTERS

 

The 2010 Fall Report of the Auditor General of Canada, tabled in the House of Commons October 26, 2010, contains findings that may cause concern about systems related to the release and accounting of imported goods.

 

Key findings from the chapter entitled Facilitating the Flow of Imported Commercial Goods—Canada Border Services Agency include:


IMPORT TPL STILL AVAILABLE FOR MAN-MADE APPAREL CONTAINING WOOL

 

Importers should note that TPL is still available on the following man-made fibre apparel containing wool even though TPL has run out.  Utilization for this category is currently at 8%.

  • Knitted garments with a composition of over 50% man-made fibres and at least 23% of wool qualify under a

REDUCTION OF 10-DIGIT HS TARIFF CLASSIFICATIONS

 

Statistics Canada is planning to eliminate over 8,000 10-digit HS classification codes.

 

The HS classifications that are proposed for elimination are seldom used and the goods that are currently classified in these 10-digit codes will be moved to a related 10-digit classification.

ACI & EMANIFEST TIMEFRAMES UPDATE

 

The implementation of eManifest in the highway mode is scheduled to begin October 31, 2010 with carriers transmitting their advance cargo and conveyance data to CBSA using one of the Electronic Data Interchange (EDI) options.

 

The CBSA has also adjusted the grace period for Advance Commercial Information (ACI) transmission requirements for US-loaded freight


ECONOMIC & TRADE AGREEMENT WITH THE EU

 

Canada’s Minister of International Trade has launched the fifth round of negotiations toward a trade agreement between Canada and the European Union (EU).  Negotiations towards the Comprehensive Economic and Trade Agreement (CETA) between Canada and the EU began October 2009.

BPA OFFICIALLY DECLARED TO BE A TOXIC SUBSTANCE

 

The Government of Canada has declared bisphenol A (BPA) to be a toxic substance that possesses risks to human health and the environment.  As a result, the Canadian Health and Environment Ministries confirmed that BPA has been added to Schedule 1 of the Canadian Environmental Protection Act, 1999 (CEPA 1999).
