On May 4, 2026, under provisions of the Canada-United States-Mexico Agreement (CUSMA), a Request for Panel Review of the final determination of dumping made by the Canada Border Services Agency (CBSA), respecting "Certain Oil Country Tubular Goods originating in or exported from Mexico," was filed with the Canadian Section of the CUSMA Secretariat on behalf of Tubos de Acero de Mexico S.A.
On the same date another Request for Panel Review of the final CBSA determination of dumping respecting "Certain Oil Country Tubular Goods originating in or exported from the United States," was filed with the Canadian Section of the CUSMA Secretariat on behalf of Maverick Tube Corporation.
CBSA issued the two final determinations of dumping on March 23, 2026. The two panel reviews will be conducted in accordance with the Rules of Procedure (Binational Panel Reviews) of CUSMA.
Chapter 10 of CUSMA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a CUSMA country with review by binational panels.
These panels are established when a Request for Panel Review is received by the CUSMA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
