(2026-07-10) Tribunal initiates expiry review of anti-dumping duties on refined sugar from several countries

The Canadian International Trade Tribunal initiated an expiry review of its orders made in August 2021 to determine if the expiry of the orders is likely to lead to continued or resumed dumping of refined sugar originating in or exported from the United States, Denmark, Germany, the Netherlands, the United Kingdom or subsidizing of the aforementioned goods originating in or exported from the European Union and is likely to result in injury to the domestic industry.

Under Canadian law, findings of injury or threat of injury and the associated special protection in the form of anti-dumping and/or countervailing duty expire five years from the date of the last order or finding (or its continuation) unless an expiry review has been initiated before that date.

In the first step of the review the Canada Border Services Agency (CBSA) will determine, by November 27, 2026, if there is a likelihood of resumed or continued dumping or subsidizing.

In the event of a positive determination by the CBSA, the Tribunal will determine, no later than May 7, 2027, whether the continued or resumed dumping and/or subsidizing is likely to result in injury to the domestic industry.
