Canada Grants Remission of U.S. Surtaxes for Essential Sectors
On April 16, 2025, the Canadian government issued the United States Surtax Remission Order (2025), providing relief from certain surtaxes imposed on U.S. imports. This order aims to support sectors critical to public health, safety, national security, and essential manufacturing.
Affected Sectors:
Public Health and Safety Organizations: Including government health research bodies, medical countermeasure producers, public health offices, emergency response services, firefighting services, law enforcement agencies, correctional services, the Department of National Defence, the Canadian Forces, and the Canadian Security Intelligence Service.
Healthcare Providers: Entities delivering medically necessary services in hospitals, clinics, laboratories, long-term care facilities, and organizations related to blood, cells, tissues, or organs for healthcare purposes.
Manufacturing and Processing Industries: Companies utilizing imported goods for manufacturing, processing, or packaging food products and beverages within Canada.
Covered Goods:
The remission applies to surtaxes paid or payable under the United States Surtax Orders (2025-1, Steel and Aluminum 2025, Motor Vehicles 2025) for goods imported by the specified sectors. Additionally, specific items listed in the schedule, such as specialized infant formulas, nutritional formulas, and medical compression garments, are included.
Conditions:
To qualify for remission, the following conditions must be met:
Goods must be imported into Canada before October 16, 2025.
No other relief claims for the surtax have been granted under the Customs Tariff for the goods.
Importers must submit a remission claim to the Minister of Public Safety and Emergency Preparedness within two years of the importation date.
